According to confirmed information, today Wednesday 5 April 2023 in the morning, the President of the Kythera Municipal Council Emmanuel Stathis Retrieved from The agenda items for the meeting of 7 April concerning sealing and fining of restaurants and playgrounds. The President informing the Councillors invoked extraordinary impediment of the legal advisor of the Municipality of Kythera (!), as it seems that the latter was scheduled to attend Friday's meeting. Despite this justification, perhaps the institutions of the Municipality have become aware even at the last minute that the specific recommendations should not be put to the discretion of the City Council but solely to the Mayor. Let's see why.
It is the Mayor who is responsible for sealing CSEs and businesses, not the City Council.
The questions raised by the attempted referral of the two issues of sealing and fines to the City Council meeting to decide on them must be answered. Why did the municipal authorities not apply the Municipal Code? It is surprising since, according to the provisions of Article 80, paragraph 6, of Law 3463/2006*, «the mayor or the president of the community is competent to give the order to seal them, who must take the relevant decision within fifteen days of the conditions being met».
And the law also states in the same paragraph: «Violation of the provisions of this paragraph shall constitute a disciplinary offence and breach of duty and shall be punished in accordance with the provisions of Articles 142 and 143 of this Law and Article 259 of the Penal Code.».
It is noted that according to Kythera.News sources the contributions of the two withdrawn items have not been sent to the councillors. Also until today 5 April 2023, the Municipality has not made any public announcement which updates the prior notice of meeting published on 3 April 2023.

- Decision a) to stop the operation of the activity and the related sealing playground based in Livadi Kythera b) fine for the unauthorized operation of the playground, (rapporteur: Mayor),
