Objection of Enchoriu to DEDDIE for a mobile phone antenna

Her strong protest to the HEDNO, expresses in a letter, the Property Committee of Kythera - Antikythera, concerning the mobile telephone antenna electrification in the position Gerakari.

In the letter, which is signed by the Chairman of the Home Affairs Committee, Evangelos Venardos, it is made clear to the State agency that, due to the special status governing the islands - and according to which any land that is not private is under the jurisdiction of the Commission - a permit is required from the Domestic, upon request by the agency concerned.

According to our information, this particular case concerns the placement of 17 aerial poles by the DEDDIE in Gerakari, without sending a request to the Committee of the Interior. Apart from this, such a move also poses the risk of a fire in this area.

The following is the letter from the Home Committee to the TEN-T:

SUBJECT: Electrification of a mobile telephony antenna at Gerakari Kythera

Ref: Your letter No. 5984/18-12-2020.

Further to the above-mentioned matter which has come to our attention, we inform you that, in accordance with Law 1416/84 article 84, Law 2941/01 article 16 par. 7, in conjunction with article 967 of the Civil Code, the management of all the areas in Kythera and Antikythera, mentioned in the above mentioned laws, belongs exclusively to the Commission of the Property of Kythera and Antikythera (N.P.D.D.) and no action can be taken on them and in all the areas mentioned in the above mentioned laws, without the prior approval of our Commission.

We assume that you would be familiar with the existing legislation as it relates to part of your territorial jurisdiction.

To date, our Service has not received any request for authorisation to intervene in any way in this area.

Bear in mind that the above legislation in force for our islands and regulating this special regime in the areas mentioned in it, takes precedence over any general provisions you may have in mind, since it is clear according to the general principles of law that any special provision takes precedence over the general one.

Following all of the above, you do not have the right to make any intervention, installation, placement, etc. in the above area, but also in other public forest and grassland areas, roads, squares, beaches, ports, etc. (article 967) without the prior approval of our organization.
