Based on the findings of the autopsy report, the prosecutor of the Mixed Jury Court of Appeal of Athens rejected all the allegations of the two defendants for the gang rape and the horrific murder of the student, Eleni Topaloudi.
«The homicide was committed by both of them in order to silence the girl. If someone didn't want to, they would call for help. The grandmother and grandfather of one were on the ground floor. All their subsequent actions prove that it was all done together,» the prosecutor pointed out during the introduction, commenting that «if Helen had participated in this scene intimately she would still be alive and there was no reason for all that happened.».
The prosecutor's words led to the mother of Eleni, who initially turned against the perpetrators (calling one of them «dirty») and then was taken outside the courtroom to calm down. At her side was Erato's mother from Lesbos, who was murdered by her husband.
According to the prosecution proposal, «for the transport it is certain that two people were required since the girl couldn't stand on her feet. Instead of helping her at the last minute, they drove her to a deserted beach. They stopped on a plateau. They threw Eleni alive into the sea never to be detected and die there. They both picked up the body, despite their claims to the contrary.
It follows from the coroner's testimony that in view of the fact that Eleni was a tall girl and was in a comatose state and it was not possible to lift her alone. Nor were there any signs of dragging on her. It is testified that they both worked together to throw Helen overboard».
The girl, as reported, was found at the Roditis' cottage along with the two defendants. «They went to the roof and had a drink. At 01.07 minutes Helen texts her friend “call me in an hour”. This message means to me that “I'm not having a good time, something is wrong”. He had an instinct. Against her will and with the use of physical violence they proceeded with her in successive intercourse. The use of violence is evidenced by the cuts on her body, the bruises, the knife marks. The injuries were sustained in life. The absence of injuries to the genitals is not troubling since she was in the water for some time. The prosecutor left no room as to the actions of the defendants, who they had to fight with the defender Eleni Topaloudi.
«Death was going to come anyway, they just chose to throw her overboard,» he said, explaining that the student «knew she was just going for kebabs, she was just dressed and if she wanted to have a threesome she would do it at her house, she didn't have to go to another house.».
The prosecutor also referred to the claim of the Rhodian defendant, who seeks the removal of the imputation of the offence.
«It did not emerge from the hearing that the defendants did not perceive their actions or had a reduced capacity of perception,» he pointed out, adding that «the psychiatrist who examined the defendants immediately after the arrest did not find any psychopathologies that could affect the».
