In a joint statement regarding the Turkish fishermen and the government’s stance were outlined by the ministers responsible for Agricultural Development, Justice, and Maritime Affairs and Island Policy: Stavros Arachovitis, Theophilos Xanthopoulos, and Nektarios Santorinios, respectively.
The statement reads:
«Once again, instead of taking a stand against the problem of illegal fishing in Greek territorial waters by Turkish fishermen—a problem that has intensified during its term in office—the government, It chooses to stir up conflict within the country and sow unacceptable division for the sole purpose of evading responsibility for its own inaction.
It falsely claims that it is unable to prevent their illegal entry into Greek territorial waters, allegedly due to the repeal of Article 401 of the old Penal Code. It is thus hiding behind an excuse, knowing that this provision, on the one hand, had fallen into disuse and was not applied in practice, and on the other hand, provided for a particularly low, non-deterrent penalty for such acts—namely, a fine or a prison sentence of 10 days to 6 months—which, by definition, was always suspended and never served. It also fails to acknowledge that the existing legal framework (Decree-Law 420/1970, Regulation (EC) No. 1005/2008 of September 29, 2008) is sufficient to address illegal practices.
Finally, The Coast Guard, which is responsible for policing the maritime borders, may enforce the provisions of Article 83, Law No. 3386/2005 regarding the illegal entry of foreign nationals into the territorial waters and thus, in a timely manner—even before the interception operation—deter Turkish vessels, based on a law that carries a much harsher penalty (imprisonment for 3 months to 5 years, with non-suspended sentences).
In conclusion, there are ways to address the issue, and they can be strengthened. What is lacking is the will. Instead, there is only political irresponsibility in exploiting a dangerous line of reasoning that attempts to justify inaction in the face of the provocative behavior of Turkish fishermen.»
