From 2020 the «penalty» imposed by the Katrougalos law for workers has been reduced pensioners in the 30% of their pension, compared to 60% which was in force before.
Therefore, the amount of the gross pension or pensions, in case of a confluence of main and supplementary pensions, is paid reduced by 30% to employees who continue to be employed and have an obligation to be insured in the main and supplementary insurance branches of the e-EFKA.
However, based on a decision by the Minister of Labour and Social Affairs, Kostis Hatzidakis, there are some categories of pensioners who are exempt from the reduction in the amount of their pension. These are:
- The e-EFKA pensioners who undertake a job or activity that is not subject to e-FICA:
- in the Territory,
- in countries to which European Regulations 883/2004 and 987/2009 apply or in countries with which Greece has concluded a transnational Social Security Convention, and
- in Institutions and Agencies of the European Union or in International Organizations coordinated pursuant to Law 3075/2002 (A΄ 297) and Law 3620/2007 (A΄ 276).
- The e-EFKA pensioners coming from the former OGA provided that they are engaged in employment subject to his insurance.
- The mentally ill of article 23 of Law no. 4488/2017 (A’176), for whom employment is appropriate for reasons of psychosocial rehabilitation, under the terms and conditions provided for in the aforementioned provisions.
- The pensioners based on the law. 612/1977 (A'164) and the provisions referring to it.
- The public sector pensioners who receive a pension in accordance with the provisions of the fourth subparagraph of point (a) of par. 1 of Article 1 and Article 26 of P.D. 169/2007 (A΄210).
- Those who receive the ex-paternity allowance (Law 1140/1981) or the allowance of article 54 of Decree 169/2007, as well as the children of insured persons and pensioners who are disabled with a disability rate of at least 67%.
- The large families, where at least one of the children is a minor or a studenti in higher or higher education and up to the age of 24 or is incapable of any gainful employment.
- The persons referred to in par. 3 of article 4 of Law No. 4387/2016 (Α΄85).
- Pensioners of other institutions and the State, provided that their annual income from employment in the agricultural sector as farmers, beekeepers, stockbreeders, poultry farmers and fishermen does not exceed ten thousand (EUR 10 000).»
