Announcement of the Public Bidding Tender for the Lease of a property in the settlement of Ammos Square

NOTICE OF PUBLIC INVITATION TO TENDER
RENTAL OF IMMOVABLE PROPERTY

The Ecclesiastical Council of the Holy Church of St. Charalambos Karavas of Kythera, in order to make the lease of a building-cell of 38,00sq.m. with the courtyard surrounding it, located in the Settlement of Ammos Square, owned by the Chapel of St. Prokopios, chapel of the Parish Church of St. Charalambos Karavas of Kythera, announces a Public Bidding Tender for the appointment of a lessee, in accordance with the following:

  • The date of the Tender is defined as 18 October 2023, day Wednesday and time 12:00 - 13:00.
    In case of an unsuccessful result on the above date, the Tender will be repeated on 31 October 2023, day Tuesday and time 12:00 - 13:00.

  • The venue of the Competition (and the replay, if necessary) is defined as the office - guesthouse housed alongside the Holy Church of Agios Charalambos Karavas of Kythera.

  • The starting price is set at the amount of 250,00 (two hundred and fifty) Euro per month, plus the applicable stamp duty of 3,6%.

  • The lease will be used exclusively as a residence in accordance with the definitions of good faith and user and commercial manners of the island of Kythera and the settlement of Ammos Square.

NOTICE OF A PUBLIC (OPEN) TENDER FOR THE LEASE OF CHURCH PROPERTY IN KYTHIRA

THE ECCLESIASTICAL COUNCIL OF THE CHURCH OF ST. HARALAMBOS KARAVAS IN KYTHERA

I N T E R N A T I O N S

That - according to article 16 of the I.I.S. Regulation No. 8/1979 on Holy Churches and Parishes, issued in accordance with the authorizing provisions of articles 1 par. 4, 36, 37 par. 8, 51 par. 2 (v. d’) of Law 590/77 ’On the Charter of the Church of Greece« - is offered for lease one (1) ecclesiastical property, located in Kytheri and specifically:

PROPERTY DETAILS:

One (1) building - cell, surface area 38,00 sq.m., with the courtyard surrounding it, located in the settlement of Karavas and specifically in the wider area within which is the chapel of Agios Prokopios, the Municipal Unit of Kythera, the Municipality of Kythera, the Regional Unit of the Islands of the Region of Attica.

CONDITIONS OF THE COMPETITION:

The lease of the above church property will be made through a public tender, the terms of which are as follows:

  1. The tender will be open and open.
  2. The minimum monthly rent is the amount of two hundred and fifty euros (250,00€). The above amount is the starting amount of the auction.
  3. The first bidder's first annual rent bid must be at least three percent (3%) above the starting price of the auction.
  4. Each subsequent bid must be at least two percent (2%) greater than the previous bid.
  5. Each offer is binding for each bidder - bidder. For the last of these or the sole bidder, if any, it shall also constitute proof that he considers the last or sole bid offered by him, as rent, to be fair, reasonable and commensurate with the rental value of the lease. The last bidder's bid also indicates that he or she waives any right to terminate the lease or to seek a reduction in rent for any defects or deficiencies existing, even if latent or apparent, or for any damage from any other cause.
  6. The annual rent of the above property will be the amount offered by the last or the only bidder at the auction, if it is awarded in its favour.
  7. The rent of the above property will be paid to the account no.452/602397-56 bank account held by the lessor at the National Bank of Greece and the proof of deposit shall be treated as evidence. The lessee will be given a written receipt by the lessor at the same time.
  8. The duration of the lease of the above described property will be three years (3 years).
  9. The use of the above described lease will be made in accordance with the definitions of good faith and of the users and customs of the island of Kythera.
  10. The lessee has the obligation to use the leasehold property in a way that does not affect the peace, health, work, safety and morals of the lessor and the neighbours. The lessee is obliged to make good use of the leasehold property, keeping it clean, otherwise the lessee is liable to pay compensation for any damage or harm caused to the leasehold property.
  11. The lessee is obliged to keep the possession of the lease, its boundaries and the lease in general in good condition, to secure it from any trespassing, with the appropriate actions, otherwise he is liable to compensation and is not exempt from paying the rent if he did not use the lease.
  12. Any conversion of the use of the lease, subleasing and partial or total cession of the use of the lease to third parties with or without consideration, without the written consent of the lessee, is absolutely prohibited.
  13. Any modification of the terms of the lease agreement, such as a re-lease or extension of the lease, shall be evidenced solely in writing, to the exclusion of any other means of proof. Any failure by the lessor to exercise in due time any of his rights, either once or repeatedly, shall not constitute a waiver of such right.
  14. Failure to pay the rent on time, as well as any other expenses related to the lease, or the violation of any of the terms of the lease contract, entails its invalidity, and only the Holy Church may invoke this invalidity. Furthermore, it gives the lessor the right to immediately and unilaterally terminate and terminate the lease, to evict the lessee from the lease in accordance with the relevant legal procedure and to claim compensation for any damage caused by the lessee's breach or violation of the terms of the lease agreement signed by the lessee. In such cases the security deposit shall be forfeited as a penalty in favour of the lessor.
  15. The lessor is entitled on appropriate days and times a) to visit the leasehold property every six months, accompanied by an engineer or expert, to check any damage or alterations to it, b) to visit the leasehold property twice a week with prospective tenants or buyers.
  16. The tenant will take possession of the lease as it is today, without the Church being obliged to incur any costs. All maintenance and damage repair costs shall be borne solely by the lessee and shall remain for the benefit of the lease, with no claim of unjust enrichment.
  17. The tenant is prohibited from making any addition, alteration or reform to the lease without the written consent of the landlord and if such additions etc. are made, with the written consent of the landlord, they shall remain for the benefit of the lease. However, the lessor shall be entitled to claim for restoration of the property to its previous condition at the expense of the lessee.
  18. At the end of the lease, the lessee is obliged, without any disturbance, to return the lease to the lessor in the condition in which he received it, otherwise he is obliged to compensate the lessor for any damage suffered due to his failure to deliver it on time.
  19. The rental guarantee mentioned below will be returned to the lessee without interest after the termination or expiry of the lease in any way and the delivery of the lease to the lessor and after any debts of the lessee from any cause have been settled.
  20. The auction will be held before the three-member committee, which was appointed by the Ecclesiastical Council of the Holy Church of Agios Charalambos Karavas of Kythera and which consists of: a) Fr. Panagiotis Diakopoulos of Nikolaos, b) Georgios Tzortzopoulos of Charalambos and c) Emmanuel Zantiotis of Ioannis as well as Panagiotis Georgas of Theodoros as an alternate member. The auction will take place on 18 October 2023 on Wednesday, Wednesday at 12:00 - 13:00 at the office - guest room located next to the Holy Church of Agios Charalambos Karavas of Kythera.

The auction may continue beyond the time specified in the notice, provided that the tenders continue uninterrupted. The committee, whose decision shall be recorded in the minutes, shall decide whether to continue the auction beyond the time specified.

In the event that the auction is deemed ineffective or unprofitable or for any reason is not held, it will be held on October 31, 2023, Tuesday at 12:00 - 13:00 without a new declaration, by simple announcement of the Church Council, which will be mentioned in the original declaration and will be posted at the door of the Church, at least five (5) days in advance. If the bidding is unsuccessful, the Metropolitan Council may approve the lease by special agreement for a maximum of four (4) years.

  1. Anyone who participates in the auction is deemed to have taken note of the terms of this notice and accepts them.
  2. Not admitted to the auction are those who for any reason owe to the Holy Metropolis of Kythera and Antikythera or to a Holy Church under its jurisdiction, or have damaged them in the past or have a dispute with them or have not fulfilled their obligations as bidders or lessees of the property of the above.
  3. Those interested in participating in the auction must submit to the committee on the day of the auction the envelope with the following documents:

A relevant promissory note of the Deposits and Loans Fund in the name of the Holy Church of Agios Charalambos Karavas of Kythera or a letter of guarantee from a recognized Greek Bank or cash, in the amount of: 1) five hundred euros (500,00 €), as a guarantee of participation in the tender.

-A photocopy of the police identity card and, if the tenderer is a foreigner, a photocopy of his/her passport and residence permit or a certificate of deposit of documents for the granting of a residence permit.

-Affidavit stating that you are not being prosecuted and have not been convicted for drug use or trafficking or for a crime against morality or financial crime.

  1. The deposit of the amount of the participation guarantee is proof that the depositor has taken note of the terms of this declaration, that he accepts them unconditionally and that he has examined the lease and found it to his absolute satisfaction.
  2. The supporting documents will be checked, numbered, stamped and initialled by the committee of three and recorded in the minutes. The minutes will then indicate the number of sheets of supporting documents. If the supporting documents are not complete, this will be recorded in the minutes and the participant will be rejected.
  3. The auction process continues through the submission of oral bids. Each oral bid must be at least 2% greater than the highest price obtained. Each bid shall be binding on the bidder and such binding shall pass successively from the first bidder to the subsequent bidders and shall be definitively borne by the last bidder. The award shall be made to the highest bidder offering the highest price, after three calls for higher oral bids have been made.
  1. At the end, the minutes, after being read in front of the participants, will be signed by all the members of the committee and by the participants present.
  2. Any objection to an irregularity concerning the procedure of the auction shall be made in writing to the Chairman of the Commission at that time, otherwise it shall not be admissible. The Committee shall decide on the objections and give reasons for its decision, making a reference to them in the minutes, without suspending or suspending the auction.
  3. After the end of the auction, the amount of the participation guarantee - as mentioned above - deposited by the other participants will be returned immediately, and for the last bidder the above amount will remain deposited until the expiration or termination of the lease, as a guarantee to ensure the exact observance of the terms of the lease contract (lease guarantee), adjusted so that it equals two (2) annual rents.
  4. In case of non-compliance of the last bidder to the above mentioned, as well as in case of non-signature of the auction minutes, the last bidder forfeits his rights from the auction, and forfeits in favor of the lessor the deposited security as a penalty and compensation and the lease of the property is awarded to the next bidder at the price offered by the last (second) bidder.
  5. Participation by proxy in the auction is permitted, but the proxy must declare that he/she is bidding on behalf of another person and must produce the legal power of attorney or a letter to that effect, under which he/she was given the mandate or power of attorney, certified by a police or other public authority as to the authenticity of the authorising person's signature. If he fails to do so, he shall be deemed to be bidding on his own behalf.
  6. The last bidder or the only bidder is obliged, after the end of the auction, to declare the exact use of the lease, which is binding and noted in the minutes of the auction.
  7. The approval or rejection of the minutes of the auction shall be made by the appropriate Metropolitan Council at its sole discretion. After the approval of the Auction Minutes and the notification thereof to the last bidder or the sole participant, the lease agreement shall be drawn up and signed.
  8. The lease is completed only after the signing of the relevant agreement and only after that the lessee receives the lease for use. The lessor does not have to install the lessee in the leasehold.
  9. In case of refusal of the last bidder or the only bidder to sign the lease contract, he forfeits his rights from the auction, and forfeits in favor of the lessor the deposited security, as a penalty and compensation. If the last bidder does not reside in the place where the auction is held, he must appoint a substitute by means of an oral declaration entered in the auction minutes. The agent, who must be resident at the place where the auction is held, shall be notified of the approval of the minutes.
  10. Counter offers are not accepted.
  11. Anyone who has a legitimate interest may file an objection for violation of a term or conditions of the declaration before the Church Council within five (5) days of the auction. The Metropolitan Council shall give a final decision on the objection.
  12. Any natural person, regardless of nationality, gender, age or other discrimination, may participate in the auction. Any person who is being prosecuted or has been convicted for the use or trafficking of drugs or for a crime against morality or a financial crime may not participate in the auction.
  13. All costs of the auction (drafting of the notice by a lawyer, publications in newspapers) are borne by the bidder and must be paid within an exclusive period of twenty (20) days from the invitation to the bidder to sign the lease contract.
  14. A summary of this notice will be posted and published in two local newspapers and on the official website of the Holy Metropolis of Kythera and Antikythera.
