The fine imposed on people over 60 years old if they have not been vaccinated against covid 19 is constitutional and legal, the full court of Council of State.
Due to the general interest of the issue as it concerns a large population group, and given the renewed increase in the number of cases coronavirus, the announcement of the judgment, before it was published, was made by the President of the Supreme Court, Dimitrios Skaltsounis, who is retiring from the Presidency of the European Parliament on reaching the age of majority Council of State, after many decades of successful service in the judiciary.
According to the decision, the fine for those over sixty is considered a «constitutionally tolerable restriction on individual rights» and is «intended to serve purposes of major public interest».
In the decision noted, that the monthly fine of EUR 100 for unvaccinated persons over 60 years of age constitutes «a reasonable incentive for the compulsory vaccination of persons over 60 years of age», while adding that it is intended «to protect persons in this age group against serious illness and death, to relieve the health system and to avert the risk of occupation of all ICU».
The decision of the Supreme Court is irrevocable, i.e. it does not change and will be published shortly. However, the announcement by the President of the Council of State for reasons of public information, makes it practicable.
